Case budgeting is a tool which should be employed in cases where it is anticipated that the representation by counsel appointed under the Criminal Justice Act (CJA) will become extraordinary in terms of cost. These cases include all capital prosecutions and capital habeas proceedings, and high-expense “mega” cases where it is anticipated that the representation will exceed 300 hours attorney time. Analyzing, organizing, and planning the factual and legal defense of the case will promote efficient and high quality representation while enabling counsel to prepare a well-reasoned budget. Any attorney appointed under the CJA to such a case is encouraged to contact the Case Budgeting Attorney and to submit a budget per the procedures described in the documents below.
